Terms of Service

These Terms govern your access to and use of Komunik, an AI receptionist service operated by Zakaria Kadaali (trading as Mirisim), a sole proprietor based in Oran, Algeria ("Komunik", "we", "us"). By creating an account or using the service, you agree to be bound by these Terms.

1. The service

Komunik is a SaaS platform that connects to your messaging channels (WhatsApp, Instagram, Messenger) and uses AI to reply to your customers, capture leads, and route conversations to your team. We may add, change or remove features over time.

2. Your account

• You must be at least 18 years old and legally able to enter contracts.
• You're responsible for keeping your password secure and for all activity under your account.
• You must give us accurate, current information when registering (business name, contact, etc.).

3. Acceptable use

You agree not to:

• Send unsolicited bulk messages (spam) using Komunik.
• Impersonate another business or person, or send misleading communications.
• Use Komunik for illegal content, harassment, fraud, or anything that violates Meta's or WhatsApp's policies.
• Reverse-engineer, scrape, or attempt to bypass rate limits or authentication.
• Use the service to handle conversations in regulated sectors (medical advice, financial advice, legal advice) without proper human oversight.

We may suspend or terminate your account if we reasonably believe you're violating these rules.

4. Trial, plans & billing

• New accounts include a 7-day free trial of the Starter plan. No credit card required to start.
• After the trial, you choose a paid plan. Subscriptions renew automatically each month unless cancelled before the renewal date.
• Prices are listed on the website and inside your dashboard. Algerian customers are billed in DZD; international customers may be billed in another currency on request.
• Usage above your plan limits incurs overage charges as stated in your plan.
• Refunds: we don't offer refunds for partial months. You can cancel at any time and keep access until the end of the paid period.

5. Your content & data

You retain all rights to the content you upload (knowledge base, system prompt, conversation data). You grant us a limited licence to host, process, and transmit that content for the sole purpose of providing the service to you.

We will never sell your content, and we will never use your conversation data to train public AI models.

6. Our service

Komunik, the platform, the brand, and the underlying software are owned by Zakaria Kadaali (Mirisim). You may not copy, redistribute or build a competing product on top of our APIs without written permission.

7. Third-party services

Komunik depends on third-party service providers (AI infrastructure, messaging platforms, payment processors, hosting). We're not responsible for outages, restrictions or policy changes from these providers, but we do our best to communicate them and minimise their impact.

8. Availability

We aim for high availability but don't guarantee zero downtime. We'll do our best to notify customers of planned maintenance and major incidents.

9. Termination

You may delete your account at any time from the dashboard or by emailing us. We may terminate or suspend access if you violate these Terms, fail to pay, or use the service in a way that creates risk for us, our other customers, or third parties.

Upon termination, your data is deleted in line with our Privacy Policy and Data Deletion procedure.

10. Disclaimer

Komunik is provided "as is". To the extent allowed by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement. AI replies may be inaccurate; you remain responsible for reviewing critical conversations and for any decisions made based on them.

11. Limitation of liability

To the maximum extent permitted by law, Komunik's total liability to you for any claim arising out of or relating to these Terms or the service is limited to the amount you paid us in the 12 months before the event giving rise to the claim. We're not liable for indirect, incidental, or consequential damages (lost profits, lost data, business interruption).

12. Governing law

These Terms are governed by the laws of the People's Democratic Republic of Algeria. Any dispute will be settled by the competent courts of Oran, Algeria, unless local law requires otherwise.

13. Changes

We may update these Terms occasionally. If a change is material, we'll let you know by email or in-app notice before it takes effect. Continued use after the change means you accept the new terms.
